TERMS OF SERVICE

OVERVIEW

This website is operated by Lashed by Holly-Rose (“LBHR”, “we”, “us”, “our”). By accessing our website, purchasing our products, enrolling in our courses, or using any of our services (collectively, the “Services”), you agree to be bound by these Terms of Service and our Privacy Policy.

Our Services are powered by Shopify, which enables us to provide our online store and digital services.

If you do not agree to these Terms, you must not use our Services.


SECTION 1 – ELIGIBILITY & ACCOUNT RESPONSIBILITY

By using our Services, you confirm that:

- You are at least 18 years of age; or

- You have parental/guardian consent; and

- All information provided by you is accurate, current and complete.

You are responsible for maintaining the confidentiality of your account and login details. Accounts may not be transferred, shared, sold or assigned.


SECTION 2 – PRODUCTS & TRAINING SERVICES

LBHR provides:

- Online training programs

- Hybrid training programs (online + in-person)

- Professional training kits (where applicable)

All course descriptions, inclusions, pricing, and delivery formats are subject to change at our discretion without notice.

We do not guarantee specific business outcomes, financial results, licensing approvals, or client acquisition as a result of completing our training.

Participation in our courses does not guarantee employment, income, or business success.


SECTION 3 – COURSE ENROLMENT & PAYMENT TERMS

3.1 Full Payment

Where full payment is selected, the total course fee is payable at the time of enrolment.

3.2 Payment Plan – Hybrid Courses

If a payment plan is offered and selected:

- The initial payment grants access to the online training component only.

- The remaining balance must be paid in full no later than fourteen (14) days prior to the scheduled in-person training date.

- Failure to complete full payment by this deadline may result in cancellation of your in-person training placement.

LBHR reserves the right to release your position to another student if payment is not received.

Access to in-person training is not confirmed until full payment has cleared.

For students selecting the kit option, kits will not be dispatched until full payment has been received.

LBHR is not responsible for missed training due to unpaid balances.


SECTION 4 – STRICT NO REFUND POLICY

To the maximum extent permitted by Australian Consumer Law:

All course fees are non-refundable, including:

Online courses

Hybrid courses

Payment plan instalments

Deposits

Training kits

This policy applies in cases including but not limited to:

Change of mind

Change in personal circumstances

Financial hardship

Scheduling conflicts

Failure to attend

Failure to complete assessments

Due to immediate access to digital intellectual property and limited in-person training capacity, refunds will not be issued.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law that cannot be excluded.


SECTION 5 – CANCELLATION & RESCHEDULING (HYBRID TRAINING)

Requests to reschedule in-person training must:

- Be submitted in writing; and

- Provide a minimum of fourteen (14) days’ notice prior to the scheduled training date.

Requests made with less than 14 days’ notice may be refused at LBHR’s sole discretion.

Where insufficient notice is given, LBHR reserves the right to:

-Refuse rescheduling; and

- Forfeit your in-person training placement.

Rescheduling is not guaranteed and is subject to availability.


SECTION 6 – NO-SHOW POLICY

Failure to attend scheduled in-person training without prior written approval will be deemed a “no-show.”

In the event of a no-show:

- The full course amount will be forfeited;

- No rescheduling, credit, or refund will be provided.


SECTION 7 – SHIPPING & TRAINING KITS

Where a professional kit is included:

- Kits will only be dispatched after full course payment has been received.

- Delivery timeframes are estimates only.

- Risk transfers to you upon dispatch.

LBHR is not responsible for carrier delays or lost parcels once dispatched.


SECTION 8 – INTELLECTUAL PROPERTY

All LBHR content is protected by Australian copyright law and international intellectual property laws.

This includes but is not limited to:

- Online training materials

- Videos

- Manuals

- Workbooks

- Assessments

- Business frameworks

- Course structures

- Teaching methods

- Marketing materials

All content remains the sole property of Lashed by Holly-Rose.

You must not:

- Copy, reproduce, modify, reword or adapt materials

- Record training sessions

- Share login details

- Distribute or resell content

- Create derivative courses or competing programs using LBHR materials

Unauthorised use may result in immediate termination of access and legal action.


SECTION 9 – COURSE COMPLETION & CERTIFICATION

Certificates of Completion are issued only where:

- All required assessments have been completed; and

- Competency has been demonstrated to a satisfactory level as determined by LBHR.

LBHR reserves the right to withhold certification where assessment standards are not met.


SECTION 10 – NON-ACCREDITED TRAINING

LBHR courses are privately delivered training programs.

They are not nationally recognised qualifications and are not government accredited courses (RTO qualifications).

Certificates issued are Certificates of Completion only and do not constitute formal government licensing or accreditation.


SECTION 11 – LIMITATION OF LIABILITY

To the maximum extent permitted by law:

LBHR shall not be liable for any indirect, incidental, consequential or economic loss arising from:

- Use of our Services

- Participation in training

- Business decisions made after completing training

- Missed income or lost profits

Nothing in these Terms limits or excludes consumer guarantees under the Australian Consumer Law where such guarantees cannot be excluded.


SECTION 12 – INDEMNITY

You agree to indemnify and hold harmless Lashed by Holly-Rose, its directors, employees, contractors and affiliates from any claims, damages, losses, or legal expenses arising from:

- Your breach of these Terms;

- Your misuse of course materials;

- Your participation in practical training.


SECTION 13 – TERMINATION

LBHR reserves the right to:

- Suspend or terminate access to any student who breaches these Terms;

- Remove access to course materials without refund;

- Refuse in-person training where policies are breached.


SECTION 14 – GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Australia and the State or Territory in which LBHR operates.

You submit to the exclusive jurisdiction of the courts of that State or Territory.


SECTION 15 – CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. Continued use of our Services constitutes acceptance of any changes.

RETURN & REFUND POLICY

Lashed by Holly-Rose (LBHR)


1. Overview

This Return & Refund Policy applies to physical products purchased through Lashed by Holly-Rose.

Separate terms apply to online and hybrid training courses (see Course Terms & Conditions).

Nothing in this policy excludes, restricts or modifies any rights you may have under the Australian Consumer Law (ACL).


2. Physical Product Returns (30-Day Policy)

We offer a 30-day return policy on eligible physical products.

You have 30 days from the date you receive your item to request a return.

To be eligible for a return:

  • The item must be unused and unworn

  • In its original condition

  • With tags attached

  • In its original packaging

  • Accompanied by proof of purchase

Returns must be approved before being sent.

Approved returns must be sent to:

Items sent back without prior approval will not be accepted.

If your return is approved, we will provide return instructions. Return shipping costs are the responsibility of the customer unless the item is faulty or incorrect.


3. Damaged, Faulty or Incorrect Items

Please inspect your order upon receipt.

If you receive:

  • A defective item

  • A damaged item

  • The wrong product

Contact us immediately at lashed.by.hollyrose@gmail.com with photographic evidence.

Under Australian Consumer Law, you are entitled to a repair, replacement or refund if a product:

  • Has a major failure; or

  • Is not of acceptable quality; or

  • Does not match the description provided.

We will assess each case in accordance with ACL requirements.


4. Non-Returnable Items

The following items are not eligible for return:

  • Personal care or beauty products that have been opened or used

  • Perishable goods

  • Custom, personalised or special-order products

  • Sale items

  • Gift cards

  • Hazardous materials, flammable liquids or gases

If you are unsure whether your item qualifies, please contact us prior to purchase.


5. Exchanges

We do not offer direct exchanges.

If you wish to exchange an item, you must:

  1. Submit a return request (if eligible); and

  2. Place a new order once the return is approved.


6. Refund Processing

Once your return is received and inspected, we will notify you whether your refund has been approved.

If approved:

  • Refunds will be issued to your original payment method.

  • Processing may take up to 10 business days.

  • Your financial institution may require additional time to finalise the transaction.

If more than 15 business days have passed since approval, please contact us at lashed.by.hollyrose@gmail.com.

Shipping costs are non-refundable unless required under Australian Consumer Law.


7. Online & Hybrid Training Courses – No Refund Policy

Due to the nature of digital products and limited-capacity training:

All course purchases are strictly non-refundable, including:

  • Online courses

  • Hybrid courses

  • Deposits and payment plan instalments

  • Training kits (once dispatched)

This includes cases of:

  • Change of mind

  • Change in circumstances

  • Scheduling conflicts

  • Failure to attend

  • Failure to complete assessments

Where digital course access has been provided, this constitutes immediate delivery of intellectual property and refunds will not be issued.

This policy operates in accordance with Australian Consumer Law. Nothing in this clause limits your rights in the event of a major failure as defined under the ACL.


8. European Union 14-Day Cooling-Off Period

If merchandise is shipped to a customer within the European Union, you may cancel or return your order within 14 days of receipt without providing a reason.

Returned items must:

  • Be unused and unworn

  • In original packaging

  • Accompanied by proof of purchase

Digital products that have been accessed or downloaded are not eligible for cancellation under EU cooling-off rules once access has begun.
